买车订金（Booking Fee）知多少？

相信大家都知道购买车子大部分的时候都需要下一笔订金（几百到上千）。
一般而言在下了订金以后，车商都会发一张invoice/receipt/booking form给你以示证明，上面多数有列明一些terms & conditions，如退款条件，有者却是写得含糊不清，或是根本没写。

基于种种原因，买家在下了订金后转了念头，不打算继续交易。这个时候某些车商/SA为了保住业绩，无所不用其极，怎么都不肯退还订金。
为了杜绝这种问题，贸销部就于2011年修改了Hire and Purchase Act 1967，增加了booking fee这一章节，内容如下：

Booking fee
30a.
(1) No owner, dealer, agent or person acting on behalf of the owner shall collect or accept a booking fee from an intending hirer before the receipt of the duly completed form set out in Part II of the Second Schedule by the hirer.
(2) The booking fee referred to in subsection (1) shall not exceed one percent  of the cash price of the goodscomprised in a hire-purchase agreement.
(3) Notwithstanding anything under this Act, the booking fee shall form part of the deposit under section 31.
(4) An owner, dealer, agent or person acting on behalf of the owner shall refund ninety percent  of the booking fee to the intending hirer upon the withdrawal of the booking of the goods comprised in a hire-purchase agreement.
(5) Any person who contravenes this section shall be guilty of an offence under this Act.

Part （1）我也无法解答何为duly completed form set out in Part II of the Second Schedule。
重点在于Part（2），booking fee不能超过货品价格的1%。假设一辆Myvi价格为RM45,000，那booking fee不应该超过RM 450.
而最重要的Part （4），当买家取消booking时，卖家必须退还90%的booking fee。
Forfeit掉买家booking fee属违法，消费者有权投诉去消费者协会，拿回90% booking fee。

其实很多都是100%退还的 下定金之前先问清楚

确实有部分是100%退还，可是有很多“前提”，如：loan 不批。
但这帖主要是告诉大家，无论基于“任何理由”而cancel booking，车商都必须退还至少90%的订金，NO Excuse.

那是否会有时间的限制？例如超过几个月后才cancell booking？(但 还没申请贷款)谢谢。

  那你就错了 如果车已经 allocate 已经处理好 E hakmilik , k1 等等文件
车商是有权利不退还订金 或 只退还部分头期
下定金 就是你已经commit 这个交易
如果以为下了就一定可以100 / 90% 退还
没下定决心 玩玩而已的话 那么也别怪人家不退还
而且VSO有注明定金是什么情况下退还的 看清楚 T&C

试过给500块定金，之后改变主意不要买那辆车；填form要退定金时我拿50块买水果篮送给那个SA。
然后500块定金很快就bank in进我户口了

如果取消交易要退还booking fee，SA要我写信给他的公司，就可以退还了
