这是我想不通的问题~我们一起来讨论下下~
Lim wrote letter to John offering to sell his prized watch for RM20.000 on 1st of May. The letter reached John on 3 of May 2008. John immediate replied stating that he was willing to pay RM20.000 for the Watch. On the same day (3 of May) Lim changed his mind about selling his watch to John and decided to send a telegram to John revoking the offer that was made on 1 of May. It so happened that both John’s letter of acceptance and Lim’s telegram was sent exactly at 4pm on 3 of may 2008. Lim can revoking the offer? John can sue Lim?

问题是他们同一时间收到彼此的信息~重点在这里~我就是不会~有读法律的朋友~帮帮下哦~

lim寄出那封信的时候已经算生效了

那~John can sue Lim lo~ 对吗？如果john 同意Lim删除~呢~
有正确的吗？生效了~还可以改的哦~只是改的时间问题~
问题是~他们在同一个时间给信息哦~Lim要改~John接受~

当然可以sue， 如果同意的话那当然没有问题
同一个时间‘’ 的问题并不存在，因为那封信是5月1号的，

under postal act 。。。当A给予offer时。。。他有权力在任何时候收回offer。。。不过当B接受A的offer 时。。。把信寄出的那刹那。。交易就已经生效。。。所以当然可以sue~
但是如果双方都愿意取消交易。。。那当然不成问题~

不是under contract act ，postal rule咩？

Yes, Lim can revoke the proposal despite the fact that revocation of proposal and acceptance of proposal were performed on the same day, and at the same time.

Pursuant to the s.5(1) of Contract Act 1950, “A proposal may be revoked at any time before the communication of its acceptance is complete as against the acceptor, bit but afterwards.” The section further provides the illustration as follows:

A proposes, by a letter sent by post, to sell his house to B.
B accepts the proposal by a letter sent by post.
A may revoke his proposal at any time before or at the moment when B posts his letter of acceptance, but not afterwards.
B may revoke his acceptance at any time before or at the moment when the letter communicating it reaches A, but not afterwards.
