10thAugust 2009 , I bought a double-storey link house . At Taman Damai Utama , Puchong . And also signed the S&P.
Before I sign the S&P , my lawyer investigated and guarantee there won’t be any problem . Due to the title of this house is “Agricultural Land” and haven’t change to “Residential” , so my lawyer keep asking the seller and developers for the data needed by bank . But until 29thDecember 2009 , developers haven’t give the undertaking letter to my lawyer .
8thJanuary 2010 , seller’s lawyer said I need to pay the rest of payment , that is 90% . Otherwise my 10% deposit will be forfeited . My lawyer reply him immediately saying they can’t forfeit my deposit , because they didn’t provide me with the complete data . We have the right to take legal action , seller’s lawyer did not reply to my lawyer after that . My lawyer did not write letter to other people anymore .
13thAugust 2010 , developers wrote a letter to my lawyer that’s about “Individual Title” . Developers ask my lawyer to hand over all the required documents , because individual title is coming out soon . Then my lawyer reply him immediately saying that my S&P isn’t complete , because they haven’t give him the required data . I keep asking they guy responsible for this case , his name is xric (he is also my cousin-in-law) . Every time I give him phone call and ask him , he just say the data isn’t complete . Till 2011 , he already caveat the title already . He tell me I don’t have to worry , then I’m at ease .
Until January 2012 , a friend of mine remind me . Then I find that it is not that simple , so I entrust my friend to investigate about the title of house . And found the house was sold to others .
By here , I would like to ask for everyone’s advice . Is there any way I can take back my 10% deposit or house ?

在 10th August 2009,我买了一间双层排屋。在 Taman Damai Utama,Puchong。并签了 S&P。 在我签 S&P 之前,我的 lawyer 已经调查了并保证是没有任何问题的。
由于这间排屋的 Title 是“农业地”并还没有转换成“住宅”Title,所以我的 lawyer 就向卖家和发展商一直不断地拿银行所需要的资料。但是直到 29thDecember 2009,发展商还没有给我律师 undertaking 的 letter。
8thJanuary 2010,卖家的律师说要在14天里给剩下的90%的钱,不然就 forfeit 我的 10% deposit。我的律师立刻回信给他说:“他不能 forfeit 我的 deposit,因为他们资料都没有给齐全我。我们有权采取法律行动。”过后卖家的律师并没有回我的律师,我的律师也没有再写信给其他的人。
直到 13thAugust 2010,发展商写了一封信给我的律师说是关于 individual title。发展商叫我的律师呈上所需要的文件,因为 individual title 要出了。然后我的律师也立刻回了他说:“我的 S&P 是不 complete 的,因为你们还没有给我所需要的资料。” 我有一直去问负责这个 case 的人,他叫 xric(他其实是我的表姐夫)。每次打电话问他,他就说资料不齐全。直到 2011 年,他已经 caveat 了那个 title。叫我不用担心,我也就放心了下来。
直到 2012 年 1 月,我在朋友的提醒下才发觉事情不是那么的简单。就委托了我的朋友去调查那间屋子的 title,才发现那间屋子已经卖给了别人。
在此我想问各位的意见,到底有什么办法可以拿回我的 10% deposit or 屋子。
